Dr M: Sodomy again? Gov't not so stupid

Dr Mahathir Mohamad said the present government is not "so stupid or unimaginative" to trump up sodomy allegations against Anwar Ibrahim all over again.
"Surely (the government) could come up with another story which would be more credible if it is deliberately plotting or conspiring against Anwar.
"The probability is that the story is the same because it is genuine," he added in a posting on his CheDet blog today.
Mahahir also said it is unlikely that Saiful Bukhary Azlan is trying to mimic the sodomy allegations levelled against Anwar 10 years ago.
"Is the present complainant a copycat? Hardly likely," he said.
"Few would care to make public such a very shameful thing as being sodomised. In fact, the last time at least two people came to see me claiming they were sodomised by Anwar.
"But they were unwilling to make a report or be witnesses in court. One of them, however, did see the imam of Masjid Negara (Taib Azimuddin, now a PAS MP) to seek advice on the religious angle," he added.
On June 28, Saiful - who was Anwar's former aide - lodged a police report claiming that the politician had sodomised him. The latter has denied this.
However, Mahathir said: "There are certain habits which are not easy to be rid off. Habitual smokers will tell you that. So will drug addicts."
'He refused to swear'
He also pointed out that Anwar had "practically refused" to swear on the Quran while Saiful on the other hand was willing to do so in front of religious authorities.
Mahathir also said Anwar can be convincing in his arguments especially with those who want to believe in him.
"The Western press has already concluded that this accusation against Anwar is the same old political plot to prevent him from becoming the prime minister.
"The last time it was I who was the prime mover. (Prime Minister) Abdullah (Ahmad Badawi) has denied he is involved this time, but the Western press and the American friends of Anwar will not be convinced and will not let him get off the hook," he added.
In 1998, Mahathir had sacked Anwar as his deputy and the latter was subsequently charged for abuse of power and sodomy.
Anwar had claimed that the allegations were part of a political conspiracy to oust him.

tunku : anwar and his supporters already made it look like its a conspiracy.so whatever the truth is, they will manipulate it and the western already concluded it as political plot. even though anwar is actually a sodomizer, they will make it look like political plot.i just don't understand why they are so blind, deaf etc.tun mahathir is right, government is not that stupid to use sodomy as political plot.its just that anwar is an addicted to ...........

m sorry to hear mahathir again on this issue. sodomy or no sodomy just follow the syariah law and rest the case. bring 4 witnesses and say so, or else forget about the whole thing and focus on more serious things in life. we are tarnishing islam, the malays and the country through this process. anyway, this issue has already become politicised, thus it has become a matter of perception. i was in sarawak the other day, and almost all the people i met there are not bothered about sodomy but the economy. they don't care what, but just admire this man called anwar. after all a lot of other sins are committed by everyone in society. corruption, for instance is worse than sodomy but people are diverted to a trivial issue that brings no economic value to the country. too sad.

does that mean TDM admit the charge 10 years ago might not have been genuine? I agree with him this time around though, no politician would be so stupid, knowing the sympathy Anwar has from his international friends and that he was vindicated long ago in the court of public opinion. Plus, the hasty, high-handed and stupid way the police handled the arrest further points that it cannot be a cunning, subtle, slit-throat political brilliance. Police just going about doing thier job as usual.

fir,
what tun was saying is that IF last time the accusation was made up story then the government will be stupid to do it again. hope you understand what he's trying to say.

Entah2 memang betul yang Anwar ni kaki liwat. Sampai dua kali dia kena tuduh. Tu sebab sakit belakang tu kot. Hahaha

Believe it or not, right from birth, all man already pronounced as sinner. Never mind if you disagree with that, the fact remains we would rather be bothered by the scourge of poor economy than the gravity of sins - sodomy, sexual abuse or satanic worship. So what's new under the Sun as long as we keep ourselves from committing such evils? We are tired of the reigning government and incompetent leaders. Please wake up from their sleep, get out and let other more capable Sinners to do their job!

I dont think that govt is that stupid to merge up the same sodomy case to pin down Anwar again.

Basically what Tun said is truth. It is just another conspiracy form Anwar. Just in case probably if you are not sure about the previous case, I have quoted interesting article regarding about the previous sodomy case by Anwar in 1998 from stephendoss. Here it goes:

"FOR THE BENEFIT OF READERS, I HAVE EXTRACTED FROM THE PAST THE JUDGMENT BY THE FEDERAL COURT OF MALAYSIA, ANWAR'S APPEAL AGAINST HIS CONVICTION ON SODOMY. THE FOLLOWING IS A MAJORITY DECISION REACHED BY THE JUDGES SITTING IN THE FEDERAL COURT ON THE ANWAR IBRAHIM APPEAL AGAINST HIS CONVICTION ON SODOMY.

PLEASE NOTE AND READ CAREFULLY THE VERDICT, THAT ALTHOUGH THE JUDGES HAD NO DOUBT IN THEIR MINDS THAT THE ACT OF SODOMY BY ANWAR IBRAHIM HAD TAKEN PLACE, BUT TO RELY SOLELY ON AZIZAN'S EVIDENCE WOULD BE UNSAFE FOR THE PURPOSES OF UPHOLDING THE JUDGEMENT.

SO DID THE ACT OF SODOMY TAKE PLACE ? YES ACCORDING TO THE JUDGES. BUT DUE TO A TECHNICALITY THEY HAVE NO CHOICE BUT TO DISMISS THE CASE.

MAJORITY JUDGMENT OF

ABDUL HAMID MOHAMAD F.C.J.

AND TENGKU BAHARUDIN SHAH TENGKU MAHMUD J.C.A.

In this judgment, Dato’ Seri Anwar bin Ibrahim will be referred to as “the first appellant” and Sukma Darmawan Sasmitaat Madja will be referred to as “the second appellant”.

The first appellant was charged with an offence punishable under section 377B of the Penal Code.

The second appellant was charged with two offences. The first charge is for abetting the first appellant in the commission of the offence with which the first appellant was charged. The second charge is similar to the charge against the first appellant i.e. under section 377B of the Penal Code.

Both the appellants were tried jointly. The first appellant was convicted and sentenced to nine years imprisonment commencing from the expiry of the sentence he was then serving in the first trial. High Court Kuala Lumpur Criminal Trial No. 45-48-1998 (1999)2 M.L.J. 1 (H.C), (2002)2 M.L.J. 486 (C.A.) and (2002) 3 M.L.J. 193 (F.C.)). The second appellant was convicted on both charges and sentenced to six years imprisonment and two strokes for each charge with the sentences of imprisonment to run concurrently. For the judgment of the High Court in the present case, see (2001) 3 M.L.J. 193.

They appealed to the Court of Appeal. Their appeals were dismissed – see (2004) 1 M.L.J. 177.

They appealed to this court and this is the majority judgment of this court.

Section 87(3) of the Courts of Judicature Act 1964 (“CJA 1964”) provides that a criminal appeal to this court “may lie on a question of fact or a question of law or on a question of mixed fact and law.” The position is the same as in the case of the Court of Appeal hearing an appeal from a trial in the High Court as in this case – see section 50(3) CJA 1964.

To summarise our judgment, even though reading the appeal record, we find evidence to confirm that the appellants were involved in homosexual activities and we are more inclined to believe that the alleged incident at Tivoli Villa did happen, sometime, this court, as a court of law, may only convict the appellants if the prosecution has successfully proved the alleged offences as stated in the charges, beyond reasonable doubt, on admissible evidence and in accordance with established principles of law. We may be convinced in our minds of the guilt or innocence of the appellants but our decision must only be based on the evidence adduced and nothing else. "

my opinion:
So, I'm not doubt that Anwar really did sodomized the kid, or the kid is just a seed planted by the government to keep Anwar's dream of taking the federal government by September 16. But I could assure one thing, Anwar himself has disrupt the whole stability of economy and peace of the country by his won actions. More disaster to come is his subordinate, The US government's interference.
