Dismiss Justice Ian Chin

Ibrahim And Karpal Concur On Move To Dismiss Ian Chin

KUALA LUMPUR, July 15 (Bernama) -- Two Members of Parliament (MPs) Tuesday concurred in asking the government to dismiss Justice Datuk Ian Chin for making statements that could affect the country's judicial system.
Datuk Paduka Ibrahim Ali (INDEPENDENT-Pasir Mas) and Karpal Singh (DAP-Bukit Gelugor), who are usually at loggerheads with each other, this time around supported each other's views on the matter.
Ibrahim said the government should take appropriate action and stop the judge from making statements that could affect the position of the judges.
"As a judge, he must abide by the code of ethics for judges and (refrain from) making statements openly as though (he is) out of control. To what extent is the government applying the code of ethics for judges," he said when debating the Judges' Remuneration (Amendment) Bill 2008 at the Dewan Rakyat Tuesday.
On June 11, Chin when hearing a case on a dispute on the results of the March 8 general election in Sarawak, disclosed that at a judges conference in 1997 former prime minister Tun Dr Mahathir Mohamad had purportedly threatened to use the special tribunal to dismiss judges who were making decisions that did not favour the government.
Karpal Singh described Chin's statement as immature and narrow-minded.
"The Bar Council too did not take any action. Is the Chief Justice prepared to take any action against him. It is better for him to be removed from the judiciary," said Karpal Singh.
Ibrahim, who was in total agreement with Karpal Singh's statement, said he was puzzled why the Bar Council was keeping quiet on this matter whereas it had always been vocal on other cases.
The MP for Pasir Mas was also against the payment of ex-gratia by the government to the judges who were dismissed during the judicial crisis in 1988, saying that it was akin to bribery and as though the government was regretful and had committed an error against them.
He said the dismissal of the judges was made according to procedure, that is, through a tribunal and the advice of the Yang di-Pertuan Agong.
