Anwar Ibrahim's lawyer revealed that his client was indeed at the Desa Damansara condominium at the time of the alleged sodomy but was there for a meeting with a number of people.According to Sankara Nair (right) today, Anwar had a meeting with “about five people” - casting a fresh alibi for the opposition leader.
“We have a watertight alibi and we have given the alibi (and their names) to the police during police investigation,” Sankara told reporters after Anwar was charged at the Kuala Lumpur Sessions Court this morning.
“He had people all around because they were all having a meeting in that house (the condominium unit),” he disclosed.
Contacted by Malaysiakini later, Sankara said Anwar has never denied that he had been to the condominium. The unit was owned by a friend to the opposition leader, the lawyer added.
Sankara confirmed that statements of the witnesses who were with Anwar at the time - and now are his alibi - had been recorded by the police.
He however did not elaborate on whether the complainant, Mohd Saiful Bukhari Azlan, was among the people present at the meeting. Saiful, 23, is the former aide who claimed that Anwar sodomised him.
Drop the case, prosecution told
Anwar was charged for engaging in sodomy with Saiful under Section 337B of the Penal Code on June 26 between 3.01pm and 4.30pm at Unit 11-5-1 Desa Damansara Condo in Bukit Damansara, Kuala Lumpur.
The provision implies consensual sex, and not assault, as the wording of the section is silent on whether it was done with or without consent.
Anwar pleaded not guilty to the charge and was freed on personal bond of RM20,000.
On July 2, Anwar had also told Malaysiakini that he had never denied going to the luxury condominium where Saiful claims the act occurred.
“I (have) never said that I have never been there,” Anwar was quoted as saying then.
Elaborating on Anwar’s case, Sankara said the legal team has a strong defence with the alibi, as well as a medical report which found there was no signs of sodomy on Saiful.
The lawyer also pointed out that the defence team has yet to receive a copy of Saiful’s police report.
With the evidence in hand, Sankara expressed hope that the prosecution will drop its case.
“We want to see how they (prosecution) want to carry out the prosecution, and we hope they will drop the case,” he said.
tunku : anwar case is very weird case. the case is not argued in court but instead in the public. if they can say anything to make him look innocent, we too can tell. he sodomized saiful (suka sama suka) before the meeting with the 5 people or after the meeting, who knows ? the people he had meeting with can lie to the court of the timing of the meeting as they are all his friends. they will do anything to safe his butt. will they be credible witnesses? why use that condo, why not meeting at moron's house or at party's office ?

because Saiful said in the report it's between 3:01pm to 4:30pm, so Anwar has meeting with the 5 between this time frame, Saiful is lying or giving the wrong info to the police. Therefore he could not be sodomised before.

If there is a strong alibi, why did he not want to give his DNA sample? Why did he not want to do the mubahalah? Why did he go and complicate things if he's really innocent? To me, these are the actions of one who has something to hide.We're no fools,Anwar !
i do not see anwar making any arguments. He merely state that he has a good alibi for the charge.
I think all anwar want to do is to show the public that the chagre is really politically motivated and nothing else. What better way to show it than to let the public know that in actual fact, the police really do not have evidence to charge him. So if there are no evidence or for that matter enough evidence to charge, why charge? Don't you think it is a real waste of time and money if that is the case?

We are very concern. Maybe concern is too mild a word, alarmed and shocked is more approriate. Malaysia has just exhibited to the international community a classic example of "Power corrupts and absolute power corrupts abosolutely". The highest office in this land abuse their power against all evidences. Clearly we are wasting public's money on a case that serve the personal agenda of a few. And the verdict practically serve no legal interest in this land of ours and will become the greatest joke ever crafted by a leader in history.
Undurlah PM. You are making a joke out of yourself. A joke that is going to be in the history books. A joke that may jeopardizes your future. And ultimately you may have to pay the price for it.

Come on guys, Anwar is represented by 7 lawyers. Lets not make any presumptions, hypothesis and theories of any kind. If he is innocent, he will be free. Remember, not everybody in our legal system are corrupted and not everything that was decided adversed to Anwar is faulty and conspirated by someone above. I am sick of all this and to me this person Anwar Ibrahim is a devil in disguise. He is going to ruin our country economically, cause sosial unrest among the races, created more hatred and I think he should go to prison for GOOD. I cherished the time in 1980's and 1990's when we, the malay, chinese and India respects each other and would not go overboard condeming or challenging anybody.

And one more point, since this case is before the court now, we also need to be responsible citizens to ensure that whatever we write, here or elsewhere, does not tentamount to subjudice.
