Saiful Give Statement To Jawi On Sodomy Allegation

KUALA LUMPUR, Aug 19 (Bernama) -- Mohd Saiful Bukhari Azlan, 23, who has accused Parti Keadilan Rakyat advisor Datuk Seri Anwar Ibrahim of sodomising him gave a statement on the allegation to the Federal Territory Islamic Religious Department (Jawi) today.
Clad in a blue shirt and black pants and wearing a songkok, he arrived at the Jawi office at 10am, accompanied by his father, Azlan Mohd Lazim, and lawyer, Zamri Idris.
Mohd Saiful is believed to have been called by Jawi to give a statement relating to his sodomy allegation.
Anwar pleaded not guilty in the Sessions Court here on Aug 8 to sodomising his former aide in a condominium here on June 26.
Last Friday, Mohd Saiful swore on the Quran at the Federal Territory Mosque that he had been sodomised by Anwar on June 26 and that it was not consensual.

tunku : now that saiful had gone to Jawi, what else anwar want to say? when is anwar going to swear??

yes, a good move. and now bring in 4 witnesses and settle the matter once and for all. if it is consensual or non-consensual the best way to settle the issue is through the syariah. those in business are now fed up when our would-be-partners overseas keep on making jokes about this matter. we feel ashamed and this has tarnished the country badly.

Anwar is ni deep trouble right now. Looks like Saiful is ready to go all out about this, to prove that the sodomy did happened. The response from Anwar- he kept on avoiding and giving excuses, uh , and collecting supports from 'old friends' all over the world.
Why do one has to go to that extend if one is innocent?
Well, actions do speaks louder than words..
and Anwar's actions tell us all...

On behalf : "This is political motivated. Why must you go give statement to the JAWI while this case is in hearing in court.. clearly this is just a way to sensationalize this case by involving more and more government agency. This is the same as you go PUSRAWI and then you go to the HKL."

Come on lah Anwar, make ur afterworld SD. It seem whatever you wish for is fulfilled. All people have to listen to you.

ANWAR is going to get desperate to win the small election in Permatang Pauh. He is losing influence form the surrounding public which previously thought he is innocent for this case and was being setup by the government. But apparently the views change since Saiful's effort of saying that ANWAR is really sodomising him had awakened people's mind and thought to the case and the attempt of ANWAR to bring down the federal government and form a new government by september 16.

Before this Anwar questioned why Saiful didnt wanted to make report at Jawi instead to the police.Now Saiful had already gave a statement after summoned by Jawi.

Now,what else Anwar has to say?

What if all convicts started swearing on the Quran that they didn't do it? Will it hold water if they are not Najib's audience?

The best is to wait for the Syariah Court judge(s) to call Anwar again, after obtaining the statement from Saiful. The Syariah Court judges know better how to handle such a case from the Islamic perspective. We do not know details of the procedures.

What "anonymous" says has a lot of sense - the sumpah-sumpah sessions now may open the watergates. Why? What if prisoners and those who are not on trial now decide to also "bersumpah" that they do not do as what being charged against them? Will the "sumpah" be accepted?

It seems that many like the idea of Saiful "bersumpah", who swore not in front of a judge, civil or syariah. Does this mean that we like the idea of a new paradigm in legal proceedings?

Come on, swearing by Almighty God is no laughing matter. What more when one has subjected oneself and the entire line of descendant till the day of reckoning at the hands of God should one be the liar. Some may now argue with the form over matter, just to discredit the poor man. Unislamic they may argue but will they do it in the islamic way if they are so true? Look, who is being defensive now? Someone will have to pay for the sins. Will you?

yes, jawi will call them both. the accuser has to prove his accusation and the accused has to rebutt. qazaf requires witnesses, so the accuser must come up with the witnesses, failing which the accuser can be punished perhaps. if there are 4 credible witnesses then the case goes on until the accuser is proven guilty. in this aspect, syariah law is practical. beyond what happens in the court would be that they are answerable to Allah in the hereafter. what bothers my mind is that, why the swearing, then the visit to jawi.. what next? so persistent. a normal person who is raped or sodomised would hide him/herself out of shame and not resort to publicity like what saiful is doing. why is saiful all out publicising himself? this, to me, is suspicious. it is just unusual for a victim to go round parading him/herself like a celebrity. has any rape victim in the world gone round persistently claiming in the media that he or she has been raped? i've never heard of this. i am just sceptical of saiful's act. quite hard to believe him. i personally feel that there is something more to the whole thing.

Actually I do not think many criminals who are Muslims would have the nerve to go do what Saiful has done. Unlike Anwar and many of his supporters who regard swearing in the name of Allah, as something trivial, even hard-core criminals would think thrice before doing it. Hmmm... sounds like someone we all know doesn't it? That would explain his extreme reluctance to just show up at a mosque to take up the challenge, wouldn't it? I doubt any of his followers can think that far.

Sekurang-kurangnya Saiful beri kerjasama pada Mahkamah dan jugak mahkamah syariah. Bukan hanya bersumpah semata2.

Tapi Yang tertuduh asyik bercakap dalam blog dan gelanggang politik untuk membela diri...tapi taknak bagi kerjasama pada polis dan mahkamah...

Semoga Allah tunjukkan kebenaran...Amin..

Seperkara untuk difikirkan kepada yang terus menerus mahu DSAI bersumpah di masjid dan seumpamanya:
Tahukah sdr bahawa seorang suami yang menjatuhkan talak ke atas isterinya (iaitu cerai) di luar Mahkamah Syariah didenda walaupun talak itu sah? Lafaz cerai mesti dibuat di dalam Mahkamah Syariah.

Jika prosedur lafaz cerai sedemikian rupa, saya berpendapat begitu jugalah sepatutnya bagi sumpah atau seumpamanya, apa lagi ke atas satu kes yang sudah menjadi "hak" Mahkamah Syariah - sepatutnya ia dilaksanakan di hapadan hakim Mahkamah Syariah. Dan dengan itu saya rasa hairan mengapa Saiful tidak sabar2 untuk bersumpah!

Dan kita juga perlu faham bahawa Anwar dan Saiful punya kedua2 peranan - pengadu dan yang dituduh. Jika di Mahkamah Sivil, Saiful di pihak pengadu manakala Anwar ialah yang dituduh, di Mahkamah Syariah pula, Anwar ialah pengadu dan Saiful ialah yang dituduh.

Berbalik kepada Saiful bersumpah di luar mahkamah, adakah ia kerana:
1. beliau bercanggah pendapat dengan pejabat peguam negara atas tuduhan ke atas Anwar yang dibuat di mahkamah sivil; atau
2. beliau tidak sabar-sabar menunggu sehingga dipanggil oleh Mahkamah Syariah atas aduan yang dibuat oleh Anwar?

Dan ada juga yang bertanya2 sama ada ia lebih kepada by-election di P44.

Akhir kalam, saya juga tertanya2 mengapa Saiful melarikan diri daripada pemberita selepas disoal di JAWI, sedangkan sebelum itu beliau atau peguam beliau terlalu "press friendly" selepas sesuatu yang beliau lakukan, contohnya selepas sumpah di masjid itu.
