Syed Azidi's lawyer Datuk Jahaberdeen Mohamed Yunoos said Husam's lawyer had told the High Court here that he wanted to withdraw the suit with freedom to file it again in the future.
"The plaintiff Husam also asked for no costs to be incurred. I objected to it because three witnesses have already been called and the plaintiff himself has not even taken the stand," Jahaberdeen said after the proceedings in chambers before Justice Mariana Yahya here Friday.
He said Justice Mariana then allowed his application for the suit to be withdrawn without freedom to refile as well as costs to be fixed at RM40,000.
Husam filed the suit on Sept 19, 2011, claiming that three articles posted on Syed Azidi's blog contained defamatory elements about him.
The articles allegedly appeared on kickdefella.wordpress.com between January and July, 2011.
